US Judge Orders Release of Abrego Garcia from ICE Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.
The case originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer alien smuggling charges, he was held in immigration custody.
In her decision, the court pointed out that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
Context of the Legal Challenge
The legal proceedings center on conflicting claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically denies this allegation.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate trial in Tennessee.
